Glugeth & Pierguidi, P.C. is announcing a $900,000 settlement on behalf of a New Jersey woman who suffered severe spinal and shoulder injuries in a rear-end motor vehicle accident. The collision caused significant trauma requiring multiple surgeries, extensive medical treatment, and resulted in the client being unable to return to work.
According to case records, the woman was seated in the rear of a passenger vehicle when another car violently struck them from behind. EMS transported her to the hospital, where she presented with neck pain, radiating numbness into her fingertips, right shoulder pain, and low-back pain. Diagnostic imaging later confirmed:
- A C4–C5 cervical disc herniation
- Additional disc bulges at multiple cervical levels
- A right shoulder SLAP tear
- Lumbar spine disc bulges impinging the thecal sac
These injuries led to a C4–C5 cervical discectomy and fusion with permanent hardware, right shoulder surgery, and numerous pain-management procedures. Despite comprehensive treatment, she continues to suffer chronic pain and functional limitations, preventing her from returning to her career in the dental field.
The at-fault driver carried only minimal insurance limits, requiring the claim to proceed under the client’s underinsured motorist (UM) coverage. Medical billing experts calculated over $272,000 in medical expenses, in addition to nearly three years of lost wages totaling more than $92,000, with the wage loss ongoing.
Despite clear liability and extensive medical documentation, the insurance carrier initially refused to make any settlement offer. After preparing the case for arbitration—including expert reports, surgical documentation, medical billing analyses, and a full damages presentation—the matter successfully resolved for $900,000.
