Dallas, TX - The U.S. Securities and Exchange Commission recently decided to file securities fraud charges against Texas Attorney General Ken Paxton in federal court in connection with allegations that he misled investors in a technology company. Criminal defense attorney Mick Mickelsen, who is not affiliated with the case, recently offered commentary on the latest developments in the ongoing legal battle in a new publication that discusses challenges faced by many public officials who often get tried in the court of public opinion prior to grand jury decisions being made.

Dissecting the Legal Facts of Cases Against Public Officials

Embattled Texas Attorney General Ken Paxton has been under public scrutiny since being accused of wrongdoing months after taking office in January 2015. According to the latest development in the saga, the SEC alleges that Paxton violated several federal securities laws in 2011 by enticing multiple individuals to raise more than $840,000 to invest in a Texas technology company without revealing he received compensation to promote the company. Paxton has denied the allegations.

In his report on the case titled “SEC Files Federal Securities Fraud Charges Against Texas Attorney General” Mickelsen says, “When such allegations are made in court, there may be steps taken to attempt to punish a defendant criminally and financially during the same time frame. It is important that public figures and others facing this type of predicament have strong legal counsel in place for the tough fight due to all of the complexities that can arise from dealing with overlapping legal cases.”

According to Mickelsen, the recent news may be indicative of more surprises to come with regard to the multiple charges being pursued against Paxton. The attorney general has also been indicted by a separate grand jury for securities fraud last year. Attorneys for Paxton moved to appeal the indictment in early 2016, and are awaiting a decision on the matter.

News reports say a decision on the securities fraud indictment appeal in the criminal case is not expected to be made until later in the year.
