According to a recent news article, President Barack Obama may try to force United States businesses to pay more overtime pay. The president directed the United States Labor Department to revamp its regulations to require overtime pay for several million additional fast-food managers, loan officers, computer technicians, and other workers who do not currently receive overtime pay.

A worker who receives overtime pay is compensated at one and one-half times his regular rate of pay for all hours over 40 that he works in a workweek. Currently, employers do not have to pay overtime pay to certain salaried workers who make more than $455 per week. Obama’s directive would raise that salary level. By raising that threshold, more workers would qualify for overtime pay.

The president’s authority to order the Labor Department to alter its regulations comes from his duty as president to enforce the Fair Labor Standards Act, the federal law that establishes overtime pay standards. Any proposed changes to the regulations will be subject to public comment before final approval by the Labor Department.

An employer who has questions about overtime pay should contact an employment lawyer in the employer’s area. This article is presented by the employment law attorneys at Clouse Dunn LLP. For inquiries, send an email to [email protected] or call (214) 239-2705.
